USCIS has begun notifying employers and their immigration counsel/attorneys of the results of a second selection lottery for the FY 2022 H-1B cap. Employers whose H-1B registrations are selected in this draw will have time from 2nd August 2021 to 3rd November 2021 to submit their petitions.
This second lottery is being conducted as the FY 2022 H-1B quota of 85,000 was not fulfilled. USCIS did not receive enough H-1B cap petitions to meet the quota during the initial filing period, which ran from 1st April to 30th June, 2021.
In the initial lottery for FY 2022, USCIS drew just 87,500 of 308,613 registrations to meet the 85,000 (28%) quota of the total number of registrations. This number was quite lower than the one in 2020, when 124,415 (45%) registrations were selected from 274,237 H-1B cap registrations received for the FY 2021. It is yet to be known as to how many additional registrations will be selected in the second draw. Employers are not required to take any action to be included in the second lottery.
